My name is Douglas Murray. This campaign is my plea for assistance to bring a matter before the courts. Please read on as I outline the events leading up to my present situation and the reasons for my appeal.

In 2017 I commenced proceedings to set aside a Binding Financial Agreement that has an embedded Binding Child Support Agreement. I self-represented. My lack of knowledge and proceedings of the court ended up in the proceedings being unsuccessful.

At the end of the proceedings, I was instructed to wait for submissions from the other party. I did not receive them. The other party’s lawyer knowingly sent the submissions to an email I was no longer using. I had been communicating effectively with the lawyer for 4 months from a new email. I could not appeal as I did not have the $3,000-$6,000 to appeal. I was then ordered by the court the costs of the hearing $11,345. As my ex wife knew I had nothing, and could not pay, she forced bankruptcy proceedings on me.

I cannot work due to the fact that the Child Support Agency would garnish my wages down to $371 per week. This does not even pay the rent for me, my current wife and three children. Further, there would be little or no Centrelink as they would see the wages as household income and not recognize that almost all of it was being garnished.

In 2011, my ex-wife and I separated.

Voluntarily, I commenced making payments to support my children and my ex-wife. Out of my salary, I only kept enough to pay rent for a single room, food (I was able to live healthily on $20 pw) and essential living expenses.

Hoping for a reconciliation, I signed a binding financial agreement in April 2012, which was replaced by another binding financial agreement in August 2012, which I signed, and which has been administered by the Child Support Agency to the present time. Again, the latter agreement essentially allowed me to pay rental for a single room, food and essential living expenses.

The critical failing of the agreement is that it provides no protection for unemployment or disability. At the time of signing, I mistakenly thought that my ex-wife would agree to alter the agreement if I became disabled and/or unemployed for more than a few months.

In January 2015, I was made redundant on the back of the oil price slump. I was able to honour the agreement until April 2016 from my redundancy payout, after which time, and up until now, I have been clocking up a debt in the books of the Child Support Agency which is currently at $250k and by the time all my children turn 18, it will be about $1 million. It is this debt that is the trigger for the garnishing of my wages and is blocking me from returning to work. I have made three proposals to my ex-wife to replace the agreement with terms that are more generous than the Child Support Agency assessed payments and which will also enable me to look after my present wife and her children. All three proposals have been rejected by my ex-wife, and she has now served me with the Bankruptcy Notice.

Amongst other things, bankruptcy will be detrimental to my chances of future employment and will make finding rented accommodation very difficult.

Thus, I am appealing publicly, especially to the Christian community, to help me with $10,000 towards bringing the matter of the agreement before the court with the help of a lawyer.

If am successful in my endeavour to set aside the agreement, the Bankruptcy can be reversed.

Then I will be able to return to work.
