REQUEST FOR DONATIONS for LEGAL FEES incurred by Merri Wetland Protection Group members for VCAT CASE AGAINST- Midfield Meats Rendering Plant, further works at Levy’s Beach site
A small group of local community members have fought further extension of the Midfield Meats Rendering Plant at Levy’s Beach, in VCAT proceedings. Midfield lodged the case with VCAT and we were original objectors, thus had to present our objections there. We opposed further development of the Rendering Plant on the grounds that it would entrench an inappropriately sited industry in a very sensitive location. The case was heard before 2 VCAT judges and was listed as a ‘major case’. Midfield Meats employed a significant legal team including a QC. Our small group felt we had no option but to engage legal assistance in order to be able to effectively present our case. These legal fees total (approximately) $5000. The VCAT decision has now been handed down, and unfortunately Midfield were granted permits to do these new works. However there are still some very big positives to come out of this case. There are many conditions on the permits, which if not met could still see the project ceased. The EPA have finally started to take action against Midfield’s Rendering Plant. This has occurred as a direct result of us summonsing them to appear at the court, and testify to the many breaches and issues that exist. The EPA have issued multiple Pollution Abatement Notices that require a significant amount of work to be done at the site. This should have a very big effect on the ongoing odour and visual amenity issues. So this is a definite win!!! The Warrnambool City Council were also very involved with this process. There is also the possibility of a community liaison group being formed, with regular meetings with the EPA, WCC and Midfield. This would mean issues raised would no longer be ignored, again a win for the community. We are requesting public donations to help us raise the money needed for our legal fees. As your group has previously supported our opposition to further development at the Rendering Plant we are writing to ask you to consider making a financial contribution to our legal costs. We would be very grateful for any amount, small or large!
